Medical futility is a determination by a health care provider that medical treatment desired by the patient should not be provided. This determination is then used to support the withdrawal or withholding of that treatment. This Guide is meant to remedy this lack of information, but more importantly, to point out some ways to challenge a medical futility decision if you disagree with the health care provider. Another important purpose of this Guide is to let readers know they are not alone, that it is important to talk openly about their experience with CANHR, the media, and policy makers. The medical futility statute is awful and needs to be changed but public exposure and discussion are needed to make that happen.

This Guide is believed to be the first publication devoted exclusively to the representation of probate conservatees faced with deprivations of their rights. The issues covered include the ethical implications of representing a person with alleged mental capacity problems, fighting the standard of proof, and ways of limiting a conservator’s powers.
